Influences & confluences des valeurs dans les Constitutions méditerranéennes

The fundamental Law of a State constitutes an ideal format for examinate in the way of identify his essentials values. Through an analysis of the writing and the substantial contents of various Mediterranean Constitutions, it can be noticed that some similar values are shared by these texts. This axiological confluence can be explain by a temporal closeness in the differents phases of Mediterranean constitutionnal revisions. And it can also be explain by the intentional purchase of an universal ideal of human rights protection, influenced by the occidental type, and the desire of being successful in their democratic transition, while they try to preserve their historical, religious and cultural particularisms.

القانون الأساسي للدولة هو الدليل المثالي للتعرف علي قيمه الأساسية . من خلال تحليل الكتابة ومحتوى مواد لمختلف دساتير بلدان البحر الأبيض المتوسط ويبد أن هناك قيم متاشابهة. تفسير هذا الالتقاء في مبحث القيمة يوجد خاصتا في القرب في الزمن بين التعديلات الدستورية التي مرت عليها خذخ الدساتيرولكن ما يبرر ذلك أيضا هو استعداد القوانين الأساسية الجديدة لتحقيق المثال الأعلى العالمي لحماية حقوق الإنسان، متأثر في هذا الاتجاه من خلال النموذج الغربي، وبالتالي انجاح الانتقال الديمقراطي على التوالي، والمحفاظة على الخصوصيات الثقافية والتاريخية والدينية.

La loi fondamentale d’un Etat constitue le support d’examen idéal pour identifier ses valeurs essentielles. Au travers d’une analyse de la rédaction et du contenu matériel de différentes Constitutions méditerranéennes, une communauté de valeurs similaires semble ainsi se dégager fortement. Cette confluence axiologique s’explique notamment par une proximité temporelle dans les phases de révisions constitutionnelles qu’elles ont tour à tour subi. Mais elle se justifie aussi par la volonté affichée par ces nouvelles Lois fondamentales d’atteindre un idéal universel de protection des droits de l’homme, influencées en ce sens par le modèle occidental, et de réussir ainsi respectivement leur transition démocratique, tout en préservant leurs spécificités culturelles, historiques et religieuses.

La legge fondamentale di uno Stato è lo strumento ideale per determinarne i valori essenziali. Da un’analisi redazionale e contenutistica delle Costituzioni dei paesi del Mediterraneo, sembra emergere una forte unità sul piano dei valori. Le ragioni di questa confluenza assiologica possono essere individuate, in particolare, nella vicinanza cronologica delle revisioni costituzionali che le hanno interessate, ma anche nella volontà, manifestata da queste nuove legge fondamentali, di raggiungere un ideale universale di protezione dei diritti umani, orientata in tal senso dal modello occidentale, e vincere la sfida della transizione democratica, pur preservando le specificità culturali, storiche e religiose.

Les Constitutions Provisoires, une catégorie normative atypique

au cœur des transitions constitutionnelles en Méditerranée

Since the end of the World War II, many Mediterranean countries adopted some pre-constitutional acts – Provisional Constitutions – to accomplish their constitutional transitions. This acts aim to put an end to the previous legal system, to regulate the present-day society and to organize the procedure for a constituent assembly. Therefore, the Provisional Constitutions play an important role in progressing constitutional transition and they provide a basis for the future and definitive constitutional order’s legitimacy and effectiveness.

منذ نهاية الحرب العالمية الثانية ، التحولات الدستورية في كثير من بلدان البحر الأبيض المتوسط مرت على اقرار قوانين أعمال قبل دستورية مسمة « الدساتير المؤقتة ». هذه النصوص التي تنهي القوانين السابقة و تنظم النظام القانوني الحالي و الاجراءات التأسيسية فلها دور أساسي في نجاح المرحلة الانتقالية، فهي أساس شرعية وفعالية النظام الدستوري القادم و النهائي.

A partir de la fin de la deuxième guerre mondiale, les transitions constitutionnelles de nombreux Etats du bassin méditerranéen sont passées par l’adoption d’actes pré-constituant, que nous appelons « Constitutions provisoires ». Mettant fin à l’ordre juridique précédent, réglementant l’existant et organisant la procédure constituante, ces textes jouent un rôle fondamental pour le bon déroulement de la transition et sont à la base de la légitimité et de l’effectivité du futur ordre constitutionnel définitif.

Dalla fine della seconda guerra mondiale, le transizioni costituzionali di molti Stati del bacino del Mediterraneo sono passate per l’adozione di atti pre-costituenti, che definiremo “Costituzioni provvisorie”. Mettendo fine al precedente ordinamento giuridico, disciplinando la situazione esistente in quel momento e organizzando la procedura di adozione dei testi costituzionali, questi testi giocano un ruolo fondamentale per il compimento della transizione e sono alla base della legittimazione e dell’effettività dell’ordine costituzionale definitivo a venire.

à propos du régime parlementaire projeté en Méditerranée

According to the author, the parliamentary system – in all Mediterranean countries – is not the one we imagine. Specifically, the author affirms that the Parliamentary system is merely an ideal, an inexistent utopian dream. Therefore, even if all of the Mediterranean Constitutions invoke it, the parliamentary system is no more than an achievement oriented tool designed to guide the competent authorities and politicians, which, like the theory of the separation des pouvoirs from which it is derived, is what gives it its usefulness.

وفقا للكاتب، النظام البرلماني – في جميع بلدان البحر الأبيض المتوسط – ليس الذي نعتقده. على وجه التحديد، و يرى الكاتب أن النظام البرلماني ليس واقع (ليس موجود) بل هو مثالي : حلم وهمي. لذلك و حتي لو كل الدساتير تذكر النظام البرلماني ،فهو الا أداة أدئية لتوجيه الهيئات و السياسيين مثل مبدأ الفصل بين السلطات الذي يستند اليه،و ذلك يعطيه فائدة.

Selon l’auteur, le régime parlementaire – dans tous les pays méditerranéens – n’est pas celui que l’on croit. Précisément, l’auteur affirme que le régime parlementaire « n’est » pas (il n’existe pas) mais ne serait qu’un idéal : un rêve utopique. Alors, même si toutes les Constitutions méditérannéennes l’invoquent, le régime parlementaire ne serait qu’un outil performatif chargé de guider les autorités constituées et les acteurs politiques ce qui, comme la théorie de la séparation des pouvoirs dont il découle, lui confèrerait une utilité.

Secondo l’autore, il regime parlamentare – in tutti i paesi mediterranei – non è ciò che si crede. Più precisamente, l’autore afferma che il regime parlamentare “non è” (non esiste), ma sarebbe soltanto un ideale: un sogno utopico. Anche se tutte le Costituzioni mediterranee lo invocano, quindi, il regime parlamentare sarebbe soltanto uno strumento performativo con il compito di guidare le autorità costituite e gli attori politici, ruolo che, come la teoria della separazione dei poteri dal quale esso deriva, ne spiegherebbe l’utilità.

La constitutionnalisation (…) des « droits » de l’opposition parlementaire

Whereas the constitutionnal texts emphatically recognize the competences of the parliamentary opposition in France, Morocco and Tunisia, the place set aside for this opposition during the constitutional process gives grounds for doubting the sincerity of such a consecration. Furthermore, the implementation of these clauses remains in the hands of the majority, while their protection by the constitutional judges is failing. Those points question the relevance of the so-called « rights of opposition ».

اذا كانت النصوص الدستورية في فرنسا، تونس و المغرب تعترف بتشدق باختصاص المعارضة البرلمانية، فالطريقة التي تم التعامل المخصص له في العملية التأسيسية تأدي الي الشك من صدق مثل هذا التكريس. بالاضافة الى ذلك، الغالبية هي المسيطرة على تنفيذ هذا الأختصاص، و الدفاع عنها من طرف الحاكم الدستوري محدود، مما يشكك في ملائمة وصفه « كحقوق » المعارضة.

Si les textes constitutionnels consacrent avec une certaine emphase des compétences à l’opposition parlementaire en France, en Tunisie et au Maroc, le traitement qui leur a été réservé au cours du processus constituant, conduit à douter de la sincérité d’une telle consécration. De surcroit, leur concrétisation est maitrisée par la majorité et leur protection par le juge constitutionnel apparait restreinte, ce qui remet en question la pertinence d’une qualification en termes de « droits » de l’opposition.

I testi costituzionali consacrano con una certa enfasi le competenze dell’opposizione parlamentare in Francia, Tunisia e Marocco, ma il trattamento che è stato riservato a quest’ultima nel corso del processo costituente spinge a dubitare della sincerità di tale consacrazione. Inoltre, è la maggioranza parlamentare a controllare l’utilizzo concreto di questi strumenti, per i quali i poteri d’intervento del giudice costituzionale sembrano limitati: ciò rimette in questione la pertinenza della loro qualificazione come “diritti” dell’opposizione.

Une résurrection de la justice constitutionnelle : l’exemple libyen

After decades spent under reign of the arbitrary, the Libyan Republic is engaged in a process of democratization of its institutions and in rebuilding the state. The objective sought by the forces of the country was to establish the rule of law to ensure the separation of powers and the rights and liberties. To achieve this, several mechanisms will be considered, including the restoration of constitutional justice. From this overview we will try in this study to consider the prospects of constitutional justice in Libya, based on the political and legal changes in the country.

بعد عشرات السنين تحت سيطرةالاستبداد، شرعة الجمهورية الليبية في عملية دمقرطة مؤسساتها وإعادة بناء الدولة. وكان هدف قوات البلاد هو ارساء سيادة دولة القانون لضمان الفصل بين السلطات والحقوق والحريات. لتحقيق ذلك، سيتم استعراض العديد من الآليات ، بما في ذلك استعادة العدالة الدستورية. من هذه النظرة حاولنا في هذه الدراسة أن نتساءل عن نظرة العدالة الدستورية في ليبيا، استنادا إلى التغيرات السياسية والقانونية في البلاد..

Après des décennies passées sous le règne de l’arbitraire, la République libyenne s’est engagée dans un processus de démocratisation de ses institutions et dans une refondation de l’Etat. L’objectif que recherchaient les forces vives du pays était d’instaurer un Etat de droit, de garantir la séparation des pouvoirs et les droits et libertés. Pour y arriver, plusieurs mécanismes seront envisagés, parmi lesquels le rétablissement de la justice constitutionnelle. A partir de cette vision globale nous essaierons de nous interroger sur les perspectives de la justice constitutionnelle en Libye, en nous appuyant sur les mutations politico-juridiques de ce pays.

Dopo decenni tracorsi sotto il dominio dell’arbitrario, la Repubblica libica ha intrapreso una rifondazione dello Stato e un processo di democratizzazione delle sue istituzioni. L’obiettivo ricercato dale forze vive del Paese era instaurare uno Stato di diritto, garantire la separazione dei poteri nonché i diritti e le libertà fondamentali. Per arrivare a quest’obiettivo, si ricorrerà a diversi meccanismi, tra i quali il ripristino della giustizia costituzionale. A partire da questa visione globale, cercheremo, attraverso questo scritto, d’interrogarci sulle prospettive della giustizia costituzionale in Libia, basandoci sulle trasformazioni politiche e giuriche in atto in questo Paese.

Les droits des étrangers dans les constitutions des pays de la méditerranée

According to a global trend, the constitutions of the Mediterranean countries are giving a more and more important place to the rights and liberties that are recognised to foreigners. It’s however easy to discover reactions of mistrust in the fundamental legal texts of the recently independent nations or of these one feeling themselves threatened.

تبعا لنازعة عالمية، دساتير بلدان البحر الأبيض المتوسط تعطي مكانا أكثر وأكثر أهمية للحقوق والحريات المعترفة للأجانب و لا يمنع الكشف في القوانين الأساسية لأحدث الدول عن استجابات احتراسية أو شعور بالتهديد.

Répondant à une tendance générale dans le monde, les constitutions des pays de la Méditerranée font une place de plus en plus importante aux droits reconnus aux étrangers ce qui n’empêche pas de déceler des réactions de méfiance dans les lois fondamentales des nations les plus récentes ou se sentant menacées.

Richiamando una tendenza generale a livello globale, le Costituzioni dei Paesi del Mediterraneo accordano un’importanza sempre maggiore ai diritti riconosciuti agli stranieri. Ciò non impedisce d’individuare delle reazioni di diffidenza nelle leggi fondamentali delle Nazioni più recenti o che si sentono minacciate.

La nouvelle Constitution tunisienne :
résultat d’un processus constituant participatif ?

The three-years-long Tunisian constitution-making process can be rightly be described as a participatory one. The adoption of the new Constitution on 27 January 2014 has to be ascribed not only to the efforts by the Constituent Assembly members, but also to the contribution by various components of civil society. However, the Tunisian participatory constitution-making needs to be critically analyzed in order to avoid a misrepresentation of the phenomenon. The paper will cast a light on civil society’s engagement in the constitution-making process, highlighting in particular the forms of participation and the principal actors involved. Some references to other constitutional experiences, and especially to the Moroccan constitutional transition of 2011, will be done and finally some conclusive remarks will be drawn.

اعتماد الدستور التونسي الجديد في 27 جانفي 2014 وربما كان نتيجة لعملية اشتراكية. ومع ذلك، إذا على يد واحدة لا بد من الاعتراف الساحل أن عمل المجلس الوطني التأسيسي تأثر بمشاركة المواطنين، وعلى الجانب الآخر لا بد من تحليل المشاركة الشعبية بعناية. والغرض من هذه المساهمة تشمل خاصة تحليل دور المشاركين في عملية التحول الدستوري التونسي. نقوم بتحليل الأطر الأساسية لإشتراك المواطنين بالتمييز بين الطريقة الرسمية وغير رسمية و أخيرا اعداد بعض الاعتبارات النهائية.

L’adoption de la nouvelle Constitution tunisienne du 27 janvier 2014 représente sans doute le résultat d’un processus participatif. Cependant, si d’un côté il faut reconnaître que les travaux de l’Assemblée Nationale Constituante ont été influencés par la participation des citoyens, de l’autre côté, il est nécessaire d’analyser avec attention la participation populaire. L’objet de cette contribution sera notamment d’analyser le rôle des participants à la transition constitutionnelle. On s’intéressera particulièrement aux principales modalités d’engagement des citoyens en distinguant entre modalités formelles et modalités informelles et, finalement, on élaborera quelques considérations conclusives.

L’adozione della nuova Costituzione tunisina del 27 gennaio 2014 rappresenta indubbiamente il risultato di un processo partecipativo. Ciononostante, se, da un lato, bisogna riconoscere che i lavori dell’Assemblea Nazionale sono stati influenzati dalla partecipazione dei cittadini, dall’altro la dimensione partecipativa deve essere analizzata con attenzione. L’oggetto di questo scritto sarà appunto l’analisi del ruolo dei partecipanti nel processo costituente tunisino e delle principali forme di coinvolgimento popolare. In particolare, verrà operata una distinzione tra modalità formali e modalità informali della partecipazione e si provvederà ad una comparazione con altre esperienze costituzionali, in particolare con la riforma costituzionale marocchina del 2011. Infine, verranno sviluppate alcune considerazioni conclusive.

La Constitution égyptienne de 2012 : juxtaposition problématique

de la sphère religieuse dans la définition de la loi et de principes démocratiques

Written by a Constituent Assembly whose political majority was Islamist, the 2012 Egyptian constitution was controversial. The main topic of debate on its content was Islam, especially articles establishing its role in the definition of the law. If such involvement of religion in the legislative sphere actually seemed anomalous when compared to other constitutions in the Mediterranean region, it did not exist at the expense of democratic principles common to these constitutions. In this regard, the juxtaposition in the constitution of these two ideas arose problems that the practice of this ephemeral text has not had time to resolve.

لأن تمت صياغة الدستور المصري لسنة 2012 من طرف جمعية تأسيسية للأغلبية السياسية الإسلامية فصار هذاالدستور جدلي. كان الموضوع الرئيسي للنقاش على محتواه هوالإسلام، ولا سيما المواد التي أسست له دور في تعريف القانون. إذا كان إشراك الدين في المجال التشريعي وبدا فعلا غير طبيعي مقارنة مع الدساتير الأخرى في منطقة البحر الأبيض المتوسط، فإنه لم يكن موجودا على حساب المبادئ الديمقراطية المشتركة بين الدساتير. في هذا الصدد، كانت تجاور هذه الأفكار في الدستور مشكلة لم يتح الوقت لحلها بممارسة هذا النص سريع الزوال.

Elaborée par une Assemblée constituante à majorité politique islamiste, la Constitution égyptienne de 2012 fut controversée. Le thème principal du débat sur son contenu était l’islam, particulièrement les articles instituant son rôle dans la définition de la loi. Si une telle implication de la religion dans la sphère législative semblait effectivement anormale au regard des autres constitutions de l’espace méditerranéen, elle n’existait pas au détriment des principes démocratiques communs à ces constitutions. A cet égard, la juxtaposition dans la Constitution de ces deux idées posait des problèmes, que la pratique de ce texte éphémère n’a pas eu le temps de résoudre.

Elaborata da un’Assemblea costituente con una maggioranza islamista, la Costituzione egiziana del 2012 è stata oggetto di controversie. Il principale dibattito sul suo contenuto riguardava l’islam, e principalmente gli articoli che riconoscevano il suo ruolo nell’elaborazione delle leggi. Se un simile coinvolgimento della religione nella sfera legislativa sembrava anomalo rispetto alle altre Costituzioni del bacino del Mediterraneo, esso non si poneva in contrapposizione con i principi democratici a esse comuni. Da questo punto di vista, la coesistenza nel testo costituzionale di queste due idee poneva diverse questioni, che il breve periodo d’applicazione di questo testo dalla durata effimera non ha permesso di risolvere.

L’influence de la religion islamique remet-elle en cause l’universalité

des droits de l’Homme dans les Constitutions méditerranéennes ?

The universality of human rights is reaffirmed by the Mediterranean constitutions. The content of these constitutions suggests it clearly. But the dual membership of countries such as Tunisia and Morocco at the universal principles of human rights and at the Arab Umma requires the reinterpretation of the meaning of universality now understood as opposing to the abstract universality. The introduction of cultural and religious specificities may contribute to the enrichment of the concept to make it more concrete.

عالمية حقوق الأنسان تم إعادة تأكيدها بواسطة دساتير دول البحر المتوسط. فمحتوى هذه الدساتير أِوحي بها صراحة. ولكن الانتماء المزدوج لبعض الدول مثل تونس والمغرب لفكرة حقوق الإنسان المعترف بها عالميا من جهة والإمة العربية من جهة اخري جعل من الضروري إعادة تفسير العالمية كفكرة متناقضة مع فكرة العالمية المجردة. فإدماج الخصوصيات الثقافية والدينية لبعض الدول يعتبر شيئا ضروريا من أجل تأصيل فكرة عالمية حقوق الإنسان وجعلها أكثر فعالية.

L’universalité des droits de l’homme est réaffirmée par les constitutions méditerranéennes. Le contenu de ces constitutions le laisse clairement penser. Mais la double appartenance des Etats, tels que la Tunisie et le Maroc, aux droits de l’homme universellement reconnus et à la Oumma arabe exige que soit réinterprété le sens donné à l’universalité désormais entendue comme s’opposant à l’universalité abstraite. L’intégration des spécificités culturelles et religieuses devant contribuer à l’enrichissement de la notion pour la rendre plus concrète.

Le Costituzioni dei paesi del Mediterraneo riaffermano l’universalità dei diritti dell’uomo, come il loro contenuto lascia intendere chiaramente. Tuttavia, la doppia adesione di Stati come la Tunisia e il Marocco ai diritti dell’uomo universalmente riconosciuti e alla Umma araba impone che sia reinterpretato il senso della nozione di universalità, che è ormai quello di una universalità sostanziale e non astratta. L’inclusione delle specificità culturali e religiose contribuisce ad arricchire questa nozione dandole maggiore concretezza.

La dialectique de l’Islam et du libéralisme dans les Constitutions de l’après

« Printemps arabe » : Egypte & Tunisie à la confluence

de deux courants universaliste

The Middle Eastern and North African attraction for Western constitutionalism has been reinvigorated by the « Arab spring », but had to cope with an Islamic resurgence. References to Islam in the new constitutions are in contradistinction to secularism, which is inherent to political liberalism. However, Egyptian and Tunisian 2014 constitutions are committed to the protection of human rights and establish semi-parlementarian regimes in lieu of autocratic presidentialist ones. These constitutions are therefore not of ‘imported products’ but attempts to synthetize a religious universal current and a legal and political one.

لقد جذب الربيع العربي انتباه المذهب الدستوري الغربي محاولا توفيقة مع إعادة الظهور المتنامي للإسلام. فالمرجعية للإسلام في الدساتير الجديدة تشكل بلا شك تراجعا للعلمانية المتصلة بالليبرالية السياسية ولكن في ذات الوقت لابد من الأخذ في الحسبان أن الدستوريين المصري والتونسي لعام 2014 يكرسون لنظام شبه برلماني ليحل بلا رجعة محل النظام الرئاسي الاستبدادي.

Le « Printemps arabe » a revigoré l’attraction du constitutionnalisme occidental tout en tendant à la concilier avec une résurgence islamique. Les références à l’Islam dans les nouvelles constitutions vont certes à rebours du sécularisme inhérent au libéralisme politique néanmoins, les constitutions égyptienne et tunisienne de 2014 consacrent la protection des droits de la personne et instituent un régime semi-parlementaire en lieu et place du présidentialisme autocratique. Ces constitutions ne sont donc pas des « produits d’importations » mais des tentatives de synthèse entre deux courants universels, l’un religieux et l’autre juridique et politique.

La « Primavera araba » ha contribuito a rinvigorire il costituzionalismo occidentale, conciliandolo al tempo stesso con il ritorno dell’Islam. I riferimenti all’Islam nelle nuove Costituzioni entrano certo in contraddizione con il secolarismo proprio del liberalismo politico. Tuttavia, le costituzioni egiziana e tunisina del 2014 consacrano la protezione dei diritti della persona e istituiscono un regime semi-parlamentare al posto del presidenzialismo autocratico. Queste Costituzioni non sono quindi dei « prodotti d’importazione », ma dei tentativi di sintesi tra due correnti a vocazione universale, l’una religiosa, l’altra giuridica e politica.

Débats autour d’une disposition constitutionnelle

After the victory of Islamist parties in the parliamentary and presidential elections after the Arab Revolt of 2011, the existence of a constitutional rule making Islam the religion of State has worried religious minorities and supporters of secularism in the Southern Mediterranean countries. The Islamic State may lead to restrain or even deprive non-Muslims of their religious freedom after the strong advance of political Islam (? Indeed, as received by the legal systems of these countries, we will see that the constitutional rule making Islam the religion of State is not a danger for the religious freedoms guaranteed by other rules in the Constitution.

بعد النجاح الملحوظ للأحزاب الإسلامية في الانتخابات التشريعية التي جري تنظيمها بعد ثورات الربيع العربي في عام 2011 أثار وجود النص الدستوري المقرر أن الإسلام دين الدولة قلق الأقليات الدينية والمناصرين للعلمانية في دول جنوب البحر المتوسط. فوجود هذا النص قد يكون سببا في التمييز العنصري للأقليات الدينية في هذه الدول وحرمانهم من حق اللجوء الي شرائعهم فيما يتعلق بأحوالهم الشخصية بعد وصول الإسلاميين للحكم. ولكن بعد دراسة متعمقة لهذا النص في النظم القانونية لدول جنوب البحر المتوسط سوف يتضح لنا أنه لا يشكل تهديدا لحقوق وحريات الأقليات الدينية المنصوص عليها في الدستور.

Après la triomphe des partis islamistes dans les élections législatives et présidentielles organisées suite à la révolte arabe de 2011, l’existence d’une disposition constitutionnelle faisant de l’Islam la religion de l’Etat a inquiété les minorités religieuses et les partisans de la laïcité dans les Etat sud-méditerranéens. La consécration de l’Etat islamique n’aura-t-elle pas pour effet de restreindre, voire de priver, les non musulmans de leur liberté religieuse après la montée en puissance de l’islamisme politique ? En effet, telle qu’elle est reçue par les systèmes juridiques de ces Etats, on verra que la disposition constitutionnelle faisant de l’Islam la religion d’Etat est insusceptible de mettre en cause les libertés régleuses garanties par les autres dispositions de la Constitution.

Dopo il trionfo dei partiti islamisti alle elezioni legislative e presidenziali organizzate in seguito alla rivolta araba del 2011, l’esistenza di una norma costituzionale che riconosce l’Islam come religione di Stato ha preoccupato le minoranze religiose e i partigiani della laicità degli Stati del Sud Mediterraneo. La consacrazione dello Stato islamico potrebbe avere come conseguenza la limitazione, se non addirittura la negazione, della libertà religiosa ai non mussulmani? In effetti, nel quadro dei sistemi giuridici di questi Stati, la norma costituzionale che fa dell’Islam la religione di Stato non può rimettere in discussione la libertà religiosa garantita dalle altre disposizioni costituzionali.

les droits fondamentaux entre liberté individuelle & dimension collective

In Mediterranean constitutional rights, principles regarding economic activities play an important role. Mediterranean “Economic Constitutions” have been shaped by freedom to conduct a business, on the one hand, and state intervention, on the other hand. Principles of market economy have been progressively affirmed at the constitutional level. Nevertheless, limitations on individual freedom allow the respect of other constitutional principles and the defense of human rights.

تحظي المبادئ المنظمة للأنشطة الاقتصادية بأهمية القوانين الدستورية المتوسطية. فالقواعد الدستورية المتصلة بالاقتصاد في دول البحر المتوسط نشأت في ظل صراع ما بين المبادرة الاقتصادية الفردية وتدخل السلطات العامة. فإذا كان مبدأ اقتصاديات السوق قد تم فرضه بواسطة الدستور, فإن القيود علي الحرية الفردية سوف يسمح بتحقيق مبادئ دستورية أخري وكذلك الدفاع عن الحقوق الأساسية.

Dans les droits constitutionnels méditerranéens, une place importante est réservée aux principes qui régissent l’activité économique. Les « Constitutions économiques » méditerranéennes se sont construites autour de la tension entre les libertés de l’initiative économique privée d’une part et l’intervention des personnes publiques d’autre part. Si les principes de l’économie de marché se sont progressivement imposés, même au niveau constitutionnel, les limites à la liberté individuelle permettent la réalisation d’autres principes constitutionnels et la défense des droits fondamentaux.

Nelle Costituzioni dei paesi del Mediterraneo, un posto importante è riservato ai principi che regolano l’attività economica. Le « Costituzioni economiche » del Mediterraneo si sono strutturate intorno alla tensione esistente tra la libertà d’iniziativa economica del privato e l’intervento pubblico. Se i principi dell’economia di mercato si sono imposti progressivamente anche a livello costituzionale, i limiti alla libertà individuale permettono di realizzare altri principi costituzionali e la difesa dei diritti fondamentali.

Result of the « Arab Spring », the Moroccan Constitution of 2011and the Tunisian Constitution of 2014 have in common unequivocal consecration of economic and social rights. This paper aims to highlight instead the place and nature of these rights in the new texts, as well as new prospects for their justiciability, without losing sight of the classic debate relating thereto.

يتقاسم الدستور المغربي لسنة 2011 والدستور التونسي لسنة 2014، المنبثقان عن « الربيع العربي »، الكثير من أوجه التشابه، من أبرزها، تكريسهما الواضح للحقوق الاقتصادية و الاجتماعية. تروم هذه الورقة تسليط الضوء على طبيعة هذه الحقوق ومكانتها في هذين النصين الجديدين، و كذا الآفاق الجديدة لقابليتها للتقاضي، و ذلك دون إغفال النقاش الكلاسيكي المتعلق بها.

Issues du « printemps arabe », les Constitutions marocaine de 2011 et tunisienne de 2014 ont le point commun d’avoir consacré sans ambage les droits économiques et sociaux. La présente contribution se propose de mettre en lumière la place et la nature de ces droits dans les nouveaux textes ainsi que les nouvelles perspectives de leur justiciabilité, sans perdre de vue le débat classique y afférent.

Frutto della “Primavera araba”, le Costituzioni marocchina del 2011 e tunisina del 2014 hanno in comune il fatto di aver affermato i diritti economici e sociali. The introduction of good governance requirements into the Moroccan Constitution : between Mediterranean confluence and international influence. The drafting of the new Moroccan Constitution in 2011 allowed to introduce among the fundamental rules which are applicable to the Cherifian Kingdom several principles and requirements about the organization and the functioning of public Administration, specially in Title XII « On good governance ». The approach initiated by the writers of the text confirms their ambition to set up an administration that meets modern standards. It is the result of a dual influence, on the one hand the constitutional experiences of the Mediterranean European States, on the other hand the developments of international financial organizations. Nonetheless, the decisive role of these external movements may challenge the legitimacy of the constitutionalisation process.

ملخص :إن صياغة الدستور المغربي الجديد لسنة 2011 كانت مناسبة لإدماج عدد من المبادئ و المتطلبات المتعلقة بتنظيم و تسيير الإدارة في المملكة المغربية وذلك في الباب الثاني عشر المعنون » الحاكمة الجيدة« . إن منهجية محرري نص الدستور كانت تجسد رغبتهم في وضع أسس إدارة حديثة، هي نتاج تأثير مزدوج، يجمع بين تجارب دول البحر الأبيض المتوسط الأوروبية من جهة و أبحاث المنظمات المالية الدولية من جهة أخرى. لكن الأثر القوي لتلك التأثيرات قد يحد من شرعية هذه الدسترة.

La rédaction de la nouvelle Constitution marocaine en 2011 a été l’occasion d’intégrer parmi les règles fondamentales applicables désormais au Royaume chérifien un certain nombre de principes et d’exigences relatifs à l’organisation et au fonctionnement de l’administration, au sein d’un Titre XII, intitulé « De la bonne gouvernance ». La démarche initiée par les rédacteurs du texte, qui traduit leur ambition de mettre en place une administration moderne, est le fruit d’une double influence, synthétisant les expériences des Etats méditerranéens européens d’une part, s’inscrivant dans les travaux d’organisations internationales financières d’autre part. Néanmoins, le poids décisif de ces influences peut remettre en cause la légitimité de ce processus de constitutionnalisation.

La redazione della nuova Costituzione marocchina nel 2011 ha fornito l’occasione per integrare tra le regole fondamentali un certo numero di principi e di esigenze relativi all’organizzazione e al funzionamento dell’amministrazione, in seno al Titolo XII, intitolato “Della buona amministrazione”. L’iniziativa dei costituenti traduce la loro ambizione di dare avvio ad un’amministrazione moderna. Essa è, inoltre, il frutto di una duplice influenza, che sintetizza, da un lato, le esperienze degli Stati mediterranei europei, e, dall’altro, i lavori delle organizzazioni internazionali finanziarie. Tuttavia, il peso decisivo di questa duplice influenza potrebbe rimettere in discussione la legittimità di questo processo di costituzionalizzazione.

The constitutionnalisation of the decentralization process cannot be analysed completely according to a normativist conception of the Constitution. If the constitutional texts give an overview of the internal organization of the Mediterranean States, which reveal a real convergence on the subject, they do not report political issues, which determine the decision to modify the structure of the State: the history, the democracy, the minority claiming and the pressure of international organizations.

إضفاء الطابع الدستوري علي الحركة اللامركزية لا يمكن تحليلها فقط وفقا لمفهوم دستوري معياري. فإذا كانت النصوص الدستورية تعطي فكرة عامة عن التنظيم الداخلي لدول البحر المتوسط بإعطاء الانطباع بوجود تقارب بينها في هذا الشأن, فإنها لا تأخذ في عين الاعتبار العوامل السياسية التي تحدد قرار تعديل الهيكل الأساسي للدولة كالتاريخ والديمقراطية ومطالبات الأقليات وكذلك ضغط كيانات عولمة القانون.

La constitutionnalisation du mouvement décentralisateur ne peut s’analyser pleinement selon une conception normativiste de la Constitution. Si les textes constitutionnels donnent une vue générale de l’organisation intérieure des Etats méditerranéens, permettant ainsi de dégager une certaine convergence en la matière, ils ne rendent pas compte des facteurs politiques qui déterminent la décision de modifier la structure fondamentale de l’Etat : l’histoire, la démocratie, les revendications minoritaires et la pression des structures de globalisation du droit.

La costituzionalizzazione della decentralizzazione non può essere analizzata da una prospettiva prettamente positivista della Costituzione. I testi costituzionali danno un’idea generale dell’organizzazione interna degli Stati del Mediterraneo, permettendo in questo modo di stabilire una certa convergenza tra loro. Tuttavia, le Costituzioni non rendono conto dei fattori politici che determinano la decisione di modificare la struttura fondamentale dello Stato : la storia, la democrazia, le rivendicazioni delle minoranze e la pressione esercitata dalle organizzazioni internazionali.
